These terms govern your use of emicode.ca and outline how Emicode ("we", "us") engages with clients. Submitting an inquiry or engaging us for a project means you accept them. Individual projects are always governed by a signed written proposal, which takes precedence over this page where the two differ.
Services
We provide web development services — landing pages, corporate websites, e-commerce platforms, APIs and integrations, AI chatbots, real-time applications, SEO, and managed hosting. The exact scope, timeline, and deliverables for each project are defined in a written proposal prepared after a discovery conversation.
Quotes and payment
- Prices shown on this site are minimum starting points in Canadian dollars (CAD) and do not constitute a binding offer.
- Project quotes are fixed-price unless the proposal explicitly says otherwise. Overruns on agreed scope are absorbed by us; changes to scope are estimated and approved in writing before work proceeds.
- We accept payment in CAD and USD on the schedule defined in the proposal.
Intellectual property
Upon full payment, you own the project deliverables: source code, design assets, and content created for you, along with the hosting and service accounts set up in your name. We may use open-source components under their respective licences and retain the right to reuse generic, non-confidential techniques and know-how.
Warranty and support
Every project includes a 30-day post-launch warranty: defects in work we shipped are fixed at no charge. Ongoing support beyond the warranty period is available under monthly retainer agreements.
Limitation of liability
To the maximum extent permitted by law, our total liability arising out of any project or the use of this site is limited to the fees actually paid for the work giving rise to the claim. We are not liable for indirect or consequential losses, including lost profits or data, except where caused by our wilful misconduct or gross negligence.
Website use
The content of this site is provided for general information and may change without notice. You may not attempt to disrupt the site, probe it for vulnerabilities without permission, or scrape it for bulk data collection.
Governing law
These terms are governed by the laws of the Province of Manitoba and the federal laws of Canada applicable therein. Disputes are subject to the exclusive jurisdiction of the courts of Manitoba.
